We, the ToolTeam® - August GmbH, are the operator of this website and of the services offered on it and are therefore responsible for the collection, processing and use of personal data within the scope of the German Federal Data Protection Act (BDSG-neu), the General Data Protection Regulation of the European Union (GDPR), the German Telecommunications Act (TKG) and the German Telemedia Act (TMG). The proper and careful handling of your personal data is of particular importance for us. Therefore, we are pleased to inform you in the following about the handling of your personal data.



1. Collection & storage of personal data and type & purpose of its use

1.1 When visiting the website

In general, you can use our website without disclosing your identity. By accessing our website, information will automatically be sent to the server of our website due to the browser used on your end device. This information will be temporarily stored in a so-called log file.

The following information will be collected automatically, without any action on your part, and will be stored until automated deletion:

•  Date and time of access
•  Name and URL of the retrieved file
•  The website from which the access is made (referrer URL)
•  The browser used and, possibly, the operating system of your computer as well as the name of your access provider.

The aforementioned data will be processed by us for the following purposes:

The legal basis for the data processing is Art. 6 para. 1 p. 1 lit. f GDPR. Our legitimate interest follows from the data collection purposes listed above. 1.2 When using our contact form

For questions of any kind, we provide you with the opportunity to contact us via a form available on our website. In doing so, it is necessary to provide a valid e-mail address for us to be able to know the origin of the request and to be able to answer it. Additional information can be provided voluntarily. It is your free decision whether you would like to enter this data in the contact form.

Data processing for the purpose of contacting us is based on your voluntarily given consent according to Art. 6 para. 1 p. 1 lit. a GDPR.
The personal data collected by us for the use of the contact form will be automatically deleted after completion of your request.

1.3 When ordering via our website

You can either place orders through our website as a guest with no need for registration or by registering in our store as a customer to place future orders more easily. Registration allows you to log in directly to our store with your e-mail address and password in the event of a future order, without having to re-enter your contact information.

Your personal data will subsequently be entered into an input mask and will be transmitted to us and saved.

When you place an order via our website, we shall primarily collect the following data, both in the case of a guest order and in case you register in the store:
•  form of address, first name, last name
•  a valid e-mail address
•  address
•  telephone number (for forwarding orders)

The collection of this data is done,
•  in order to be able to identify you as our customer;
•  in order to be able to process, execute and handle your order;
•  in order to correspond with you;
•  for billing;
•  for the settlement of any existing liability claims, as well as the assertion of possible claims against you;
•  to ensure the technical administration of our website;
•  in order to manage our customer data.

As part of the ordering process, consent will be obtained from you for the processing of this data.

The data processing is carried out in response to your order and/or registration and is necessary for the aforementioned purposes for the appropriate processing of your order and for the mutual fulfillment of obligations arising from the purchase contract in accordance with Art. 6 para. 1 p. 1 lit. b GDPR.



2. Data sharing

A transfer of your personal data from us to third parties will only be made to the service partners involved in the processing of the contract, such as the logistics company responsible for delivery and the credit institution responsible for payment matters. In cases where your personal data is passed on to third parties, however, the scope of the data transferred is limited to the minimum necessary. Your personal data will not be transferred to third parties for purposes other than those mentioned above. We shall in any case only pass on your personal data to third parties if:

•  you have given your express consent to do so in accordance with Art. 6 (1) p. 1 lit. a GDPR;
•  the disclosure is necessary pursuant to Art. 6 (1) p. 1 lit. f GDPR for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding legitimate interest in the non-disclosure of your data;
•  there is a legal obligation for the disclosure pursuant to Art. 6 (1) sentence 1 lit. c GDPR; and
•  this is legally permissible and necessary for the processing of contractual relationships with you according to Art. 6 para. 1 p. 1 lit. b GDPR.

In the course of the ordering process, consent will be obtained from you for the transfer of your data to third parties.



3. Duration of storage

After cancellation of the purchase process, the data stored by us will be deleted. In the event of the conclusion of a contract, all data relating to the contractual relationship shall be stored until the expiry of the retention period under tax law (6 years). Your name, address, purchased goods and date of purchase will also be stored until the expiry of the product liability (10 years). The retention periods result from § 147 para. 2 in connection with para. 1 no. 1, 4 and 4a AO, § 14b para. 1 UStG (sales tax law).

Data processing is performed on the basis of the statutory provisions of § 96 (3) TKG and Art. 6 (1) a) (consent) and/or b) (necessary for the performance of the contract) of the GDPR.



4. Security

During your visit to our website, we use the common SSL (Secure Socket Layer) procedure in conjunction with the highest level of encryption supported by your browser. As a rule, this is a 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual website of our Internet presence is transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser.

It is pointed out that data transmission on the Internet (e.g. communication by e-mail) may have security gaps. Complete protection of data against access by third parties is not feasible.

We use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

During your visit to our website, we use cookies and web analytics services. For more detailed explanations, please refer to sections 9 and 10 of this privacy policy.

We hereby expressly object to the use of contact data published within the scope of the imprint obligation by third parties for the purpose of sending advertising and information material that has not been expressly requested. The operators of the websites expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, for example by spam mails.



5. Newsletter

We offer you the possibility to subscribe to our newsletter on our website. In this newsletter we provide information about our offers at regular intervals. In order to receive our newsletter, you need a valid email address. We will check the e-mail address you have entered to see whether you are actually the owner of it or whether its owner has authorized the receipt of the newsletter.

With your registration to our newsletter we will save your IP address, as well as the date and the time of your registration. This serves as our safeguard in case a third party misuses your e-mail address and subscribes to our newsletter without your knowledge. No further data is collected on our part. The data collected in this manner will only be used for the purpose of receiving our newsletter. The data will not be passed on to third parties. Likewise, the data collected in this way is not compared with data that may be collected by other components of our website.

You can unsubscribe from the newsletter at any time. This can be done either by clicking on a link at the end of each newsletter or by sending us an email to [email protected].

The legal basis for the processing of data after registration for the newsletter by you as a user is, in the case of consent on your part, Art. 6 para. 1 lit. a GDPR.



6. Data subject rights

You have the right:

•  according to Art. 15 GDPR to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;

•  according to Art. 16 GDPR to immediately request the correction of incorrect data or completion of your personal data stored by us;

•  according to Art. 17 GDPR to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right of free expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defense of legal claims;

•  according to Art. 18 GDPR to request the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer need the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing pursuant to Art. 21 GDPR;

•  according to Art. 20 GDPR to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request its transfer to another person in charge;

•  according to Art. 7 p. 3 GDPR to revoke your consent at any time. This means that we may no longer continue the data processing based on this consent in the future and

•  according to Art. 77 GDPR to complain to a supervisory authority. As a rule, for this purpose you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters.

7. Right of opposition

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) p. 1 lit. f GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are grounds for doing so that arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right to object, which will be implemented by us without specifying any particular situation.

9. Cookies

Cookies help in many aspects to make your visit to our website easier, more pleasant and more useful. We use web analysis services for the purpose of demand-oriented design and continuous optimization of our website. In this context, pseudonymized usage profiles are created and cookies are used (see clause 9). The information generated by the cookie about your use of this website, such as

14.1 Collection and disclosure of information

15. Privacy policy for the use of Hotjar

On our pages we use Hotjar to better understand the needs of our users and to optimize the offer on this website.
Using Hotjar's technology, we get a better understanding of our users' experiences (e.g., how much time users spend on which pages, which links they click, what they like and dislike, etc.). This helps us to orient our offer according to the feedback of our users.
